La Contralogía Delegada Intersectorial No. 10 Grupo Interno de Trabajo Coordinación para la Responsabilidad Fiscal – SGR, ordenó archivar, por inexistencia de daño fiscal, el poprceso de responsabilidad que adelantaba contra el Director General actual de la Corporación Autónoma Regional de la Guajira – CORPOGUAJIRA, Samuel Santander Lanao, el ex Director General Luis Manuel Medina y otros funcionarios, por los contratos de obra y consultoría que se celebraron para la restauración activa y pasiva de los ríos Tomarmón, Cañas y Jeréz, en los municipios de Riohacha y Dibulla.
La defensa adelantada por los abogados Javier Rojas Martínez y Érika Rojas Vásquez, de la firma Rojas & Vásquez Abogados SAS, logró acreditar que no existió daño patrimonial al erario público, cierto, actual y cuantificable y que, por el contrario, los medios probatorios valorados conducen a la certeza de que no existió daño daño patrimonial indemnizable en la ejecución de los contratos que totalizan dos mil doscientos tres millones setecientos ochenta y tres mil trecientos setenta y siete pesos ($2´203.783.377).
En palabras de la Contraoloría, «el análisis técnico y jurídico realizado en el presente proceso de Responsabilidad fiscal permite desvirtuar el hallazgo fiscal relacionado con la supuesta deficiente calidad de las obras ejecutadas, demostrando que estas cumplen con las especificaciones técnicas y la normativa vigente. Esto evidencia la ausencia de un detrimento patrimonial y confirma la correcta ejecución y administración de los recursos en el poryecto en cuestión», concluyó el fiscalizador.
