En dos sentencias de unificación de tutela, adoptadas en la sesión del 11 de septiembre del presente año, la Corte Constitucional amparó el derecho al debido proceso de la Procuraduría General de la Nación lesionado por la Subsección B de la Sección Segunda del Consejo de Estado, al anular las sanciones disciplinarias de destitución e inhabilidad general que impuso en los años 2012 y 2016 contra el ex senador Eduardo Carlos Merlano Morales y el ex gobernador Juan Carlos Abadía Campo, respectivamente.
La Corte Constitucional encontró que la anulación de las sanciones disciplinarias por parte de la Subsección B de la Sección Segunda del Consejo de Estado desconoció que para el momento en el que la Procuraduría ejerció sus competencias, lo hizo amparada por el marco constitucional y legal, así como por las decisiones con efectos de cosa juzgada que validaron su atribución para disciplinar a los servidores públicos de elección popular e imponer las sanciones mencionadas al amparo de la Ley 734 de 2002.
La Sala Plena también recordó que, con posterioridad a la sentencia de la Corte Interamericana de Derechos Humanos en el caso Petro Urrego contra Colombia, la Corte Constitucional armonizó la protección de los derechos políticos con los principios constitucionales que guían la función pública y la institucionalidad prevista en la Constitución en la Sentencia C-030 de 2023, sobre la cual recae el efecto de cosa juzgada y, por lo tanto, debe ser cumplida por todas las autoridades.
Como consecuencia de esta protección, la Sala Plena decidió dejar sin efectos las decisiones proferidas por la Subsección B de la Sección Segunda del Consejo de Estado y ordenar a dicha autoridad judicial proferir una nueva providencia en cada uno de los casos, en las que resuelva los cargos de nulidad presentados por los disciplinados contra los fallos sancionatorios, teniendo en cuenta que la Procuraduría General de la Nación actuó con la competencia para sancionarlos con destitución e inhabilidad general.
